IMPLEMENTATION OF PLANNING PERMISSIONS - AUGUST 2010
Planning permission is typically granted under the condition that the development must be commenced within 3 years of approval. Due to the econmic downturn many clients are in a position where developments have been put on hold and are faced with a situation where the expiration of their planning permission is approaching fast.
W R Dunn & Co Ltd. have recently advised two clients regarding this matter and have encouraged a 'material start on site' in order to secure their permission in perpetuity (ie. to make a start on the construction which will allow the permission to be valid indefinitely). The projects were the conversion of a derelict barn and the construction of a new-build detached residence - both of which could result in challenging negotiations if the permission had lapsed and a new application was necessary.
An alternative option which was explored would have been to take advantage of new government legislation to extend the life of the existing permission.
